These Terms of Service apply to your use of www.sewersurgeon.com.au (the Website) and to enquiries and bookings you make through it. By using the Website, submitting an enquiry or booking a service, you agree to these terms.
In these terms, Sewer Surgeon, we, us and our mean Sewer Surgeon Pty Ltd (ABN 61 607 646 293, ACN 607 646 293), NSW contractor licence no. 296406C, of 125 Wigram Road, Forest Lodge NSW 2037. You means the person using the Website or booking our services, including anyone booking on behalf of an owner, tenant, strata scheme or agency.
When we quote for work, our Terms and Conditions of Trade accompany that quotation. Your agreement with us is made up of our quotation, those Terms and Conditions of Trade, and any contract document we enter into with you.
This page covers your use of the Website and the enquiry and booking process, and explains the main trading terms in plain English so you can read them before you book. If anything on this page conflicts with the Terms and Conditions of Trade attached to your quotation, or with a written contract we have signed with you, those documents prevail.
We provide drainage services across Sydney, including blocked drain clearing, pipe relining, blocked sewer repairs, tree root removal, CCTV drain inspections, hydro-jet drain cleaning, robotic cutting, stormwater drainage and 24/7 emergency blocked drain response. The services for your job are the works described in our quotation.
The method we use depends on what we find on site. Where we have quoted a replacement in PVC, we may carry out the work by trenchless pipe relining instead if our team considers that method technically viable and it meets the same functional and warranty outcomes.
Submitting a form or calling us is a request for service, not a confirmed booking. A booking is confirmed when we agree an attendance time with you.
You must give us accurate details, including the service address and a working contact number. If you book on behalf of someone else, you confirm you have their authority to arrange the work and to share their details with us.
For emergencies such as an overflowing drain or a sewer backing up, call us on 1300 734 677 rather than using the online form.
Prices shown on the Website, including cost ranges for blocked drain clearing and pipe relining, are indicative only. They are not quotes.
We give you a price for the works before any work begins, usually after a CCTV inspection. We may revoke, withdraw or vary a quotation at any time before you accept it in writing. Unless stated otherwise, written quotes are valid for 30 days and all prices include GST.
If you ask us to attend your property to inspect the problem or prepare a quotation, a call-out fee applies:
Where a current promotional offer applies, such as a $0 call-out offer, that offer applies instead of the fee above. We will confirm any applicable fee or offer with you when you book, before we send a technician.
A CCTV drain inspection is included at no charge when you go ahead with drain clearing or pipe relining work. A CCTV inspection on its own, or where you choose not to proceed with the recommended work, is charged at $350 (incl. GST). We will confirm this with you before the inspection starts. You are entitled to a copy of your inspection footage.
Underground pipework can contain hidden defects, collapses, obstructions, unknown junctions, droppers and changes in depth or direction that cannot be identified until the work starts.
If we identify a defect, condition or additional work outside the scope of our quotation that may affect the performance, completion or integrity of the quoted works, we will tell you and give you our recommendation. You must tell us within 24 hours whether you approve or decline that additional work, so the job is not held up. We only carry out additional work after you approve it, and it may be charged as a variation.
If you decide not to proceed with additional work we recommend, that does not by itself affect the warranty on the work we have completed under our quotation.
Where you reduce the scope of the works, we may reduce our fee proportionately, allowing for the profit and overhead margin that would otherwise have applied.
Unless our quotation says otherwise, the property owner pays for road opening permits, council approvals, Sydney Water approvals, traffic control and related compliance requirements, charged as a variation where applicable.
Trenchless methods such as pipe relining avoid excavation in most cases, but site conditions can still require digging to access, repair or complete the works. Where excavation is reasonably necessary, we may carry it out. The location, method and extent of any excavation is determined by us, based on technical requirements, safety and site conditions.
A pipe being relined must stay free of water flow while the liner is installed and cured. We will tell you when the line cannot be used. We are not liable for damage to the liner caused by water use or discharge from fixtures connected to the line during that period, and any work needed to repair or reinstall the liner in that case is a variation and is charged accordingly.
We complete the works by the completion date in our contract document, and use all reasonable endeavours to complete them in a timely manner. If completion is delayed for reasons beyond our control, including inclement weather, you agree to a reasonable extension of time. The works are complete when they can reasonably be used for their intended purpose.
You must give us adequate and safe access to the property, including to inspect it and to complete the works. You also agree to:
You warrant that you have the right to occupy the property, that you hold adequate property damage insurance, and that the information you give us for our quotation is true and correct.
If we cannot get proper access at the agreed time, we may postpone the work. If we cannot reasonably arrange another time, we may end the agreement, and you agree to pay the applicable call-out fee and any costs we have incurred on materials for your job.
Many older Sydney properties have earthenware or clay pipes that may already be cracked, displaced or close to failure. We will tell you if our inspection shows a risk that clearing may affect a damaged section, and we will discuss your options before continuing.
If you cancel before we begin the works, you agree to reimburse us for any goods or services we have bought or committed to buy for your job, such as a pipe relining liner, and to pay the applicable call-out fee.
You agree to pay our tax invoices in full within 3 calendar days of receiving the invoice.
You agree not to set off or withhold any part of the fee. If you have a claim against us, tell us and we will work to resolve it separately from your payment obligation.
We do not require a deposit. Interest-free finance is provided by a third-party finance provider, not by us; approval, fees and repayment terms are set by that provider under its own terms.
If payment is late. If you do not pay on time, or you become bankrupt or insolvent, or you unreasonably delay or prevent us from completing the works, then:
Retention of title. Legal and equitable title in any goods we supply stays with us until our fee is paid in full. Until then you hold those goods as our bailee and fiduciary agent, and to the extent the law allows, you authorise us to enter the property to repossess them if you are in default.
We will, within a reasonable time of you telling us, make good any defects in the works we have completed.
What is covered. We guarantee only the sections of your drain line that we have replaced, repaired or relined.
What is not covered:
What voids the warranty. The warranty may be voided if you or another company use high-pressure jet blasters or electric eels to clear blockages, if water or sewer flow is used during pipe relining rehabilitation, if annual inspections are not carried out by us, or if unauthorised modifications or repairs are made to the relined section.
Junction cuts. Where junctions have been cut into the liner for access to branch lines, we cannot guarantee the seal at those points. We recommend installing a satellite junction, at additional cost, to cover that section.
50-year life. Any stated 50-year guarantee is subject to the manufacturer's warranty terms and conditions.
How to make a claim. Contact Sewer Surgeon Pty Ltd at 125 Wigram Road, Forest Lodge NSW 2037, on 1300 734 677 or at info@sewersurgeon.com.au. Give us your name, the service address, the approximate date of the work and a description of the problem, and we will arrange an inspection. You are responsible for your own costs of making the claim, such as your phone calls; we cover the cost of the inspection and of any rectification under the warranty.
These guarantees are in addition to your other rights and remedies under a law in relation to the goods or services to which the warranty relates.
Where the Home Building Act 1989 (NSW) applies, we give you the statutory warranties under that Act, including that:
Where that Act applies to your job, we will give you a written contract that complies with it before work starts.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Nothing in these terms or in our Terms and Conditions of Trade excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to section 16, and to the extent permitted by law:
To the extent permitted by law, you indemnify us against claims arising from your default under the agreement.
Content on the Website, including our blog, Knowledge Base, cost guides and the Drain Problem Checker, is general information only. It is not a diagnosis of your drains. The only reliable way to confirm the cause of a drain problem is an on-site inspection.
We work to keep the Website accurate and up to date, but we do not guarantee it is free from errors or always available.
Reviews shown on the Website come from real customers, including via Google. Individual experiences vary, and a review does not guarantee the same outcome for your job.
All content on the Website, including text, images, videos, logos and the Sewer Surgeon name, is owned by or licensed to Sewer Surgeon Pty Ltd. You may view and print pages for your personal use. You may not copy, reproduce or republish our content for commercial use without our written permission.
The Website links to third-party sites such as Google, Facebook, Instagram, LinkedIn and YouTube. We do not control those sites and are not responsible for their content or privacy practices.
We handle your personal information in line with our Privacy Policy.
If you are unhappy with our work or service, contact us first on 1300 734 677 or at info@sewersurgeon.com.au and we will try to resolve it quickly. If we cannot resolve it, you can contact NSW Fair Trading.
Force majeure. Neither you nor we are liable for delays or failures in performance caused by circumstances beyond that party's reasonable control. The affected party must notify the other in writing promptly when those circumstances cause a delay and when they stop. If they continue for more than 3 months, either party may end the agreement on 28 days' written notice.
No reliance. In entering into an agreement with us, you have not relied on any prior representation that is not contained in that agreement.
Notices. Notices we give you may be sent to any residential address or email address you have given us.
Severability. If a clause becomes unenforceable, it is severed to the extent possible and the remaining clauses are unaffected.
Waiver. No party may rely on the words or conduct of another as a waiver of a right unless the waiver is in writing and signed by the party granting it.
Changes. We may update these terms from time to time. The version on the Website when you book is the version that applies to your job.
Governing law. These terms are governed by the laws of New South Wales, Australia, and both parties submit to the non-exclusive jurisdiction of its courts.
